Terms of Service

1. Who can use I'm Here

• Consumer accounts are for people who are 18 or older and can legally use venue-based social matching services.
• Partner accounts are for invited venue owners, operators, and authorised staff only.
• You must provide accurate account information, keep your credentials secure, and use the correct portal for your role.

2. What the service does

I'm Here lets people scan a venue QR, enter a live venue room, see people who are physically present or recently active in that room, send waves, and chat only after a mutual wave.

The partner portal lets assigned venues manage live status, QR access, privacy-safe people and safety views, waitlist operations, analytics, and venue settings.

3. Venue presence and in-person decisions

• Room access is based on venue QR scans, active sessions, heartbeat activity, and venue live-state rules.
• A profile appearing in a room does not guarantee identity, availability, compatibility, interest, or continued physical presence.
• You are responsible for your in-person choices. Meet in public areas, respect venue staff, and leave any interaction that feels unsafe.

4. Respect and safety rules

• Do not harass, threaten, pressure, stalk, impersonate, exploit, or discriminate against anyone.
• Do not use offensive, sexual, hateful, violent, or otherwise inappropriate language or profile content.
• Only message people after a mutual match and stop interacting when someone is not interested.
• Do not evade blocks, kicks, bans, venue removals, rate limits, safety controls, or account restrictions.
• Reports, blocks, venue kicks, and admin moderation may affect account access, room access, matches, and messages.

5. Partner responsibilities

• Partners may use operational data only to run their assigned venues, support guest safety, manage live status, handle waitlists, and understand venue performance.
• Partners must not copy, sell, scrape, export, profile, contact, or market to users outside the platform's allowed venue and waitlist workflows.
• Partners must keep partner credentials private, remove staff access when no longer authorised, and tell us quickly about suspected misuse or unauthorised access.
• Partner safety views are intentionally limited. Do not try to identify reporters, demand private chat content, or bypass privacy limits.

6. Profiles, messages, reports, and content

• You are responsible for profile details, photos, messages, reports, and other content you submit.
• You give I'm Here permission to host, display, transmit, moderate, and process that content as needed to provide, secure, improve, and enforce the service.
• We may remove content, restrict accounts, preserve evidence snapshots, or share safety information with venues, admins, law enforcement, or emergency contacts when appropriate.

7. Payments, subscriptions, and paid features

• Paid room passes, subscriptions, boosts, and other paid features are offered as displayed in the app at checkout.
• Payments are processed through Stripe or another payment provider. We do not need your full card number to operate the app.
• Subscription changes, cancellations, expirations, refunds, and entitlement updates may depend on payment-provider records and the plan rules shown at purchase.

8. Service availability and changes

• Rooms, venue schedules, QR codes, waitlists, realtime updates, notifications, and billing features may be delayed, unavailable, limited, or changed.
• We may update the service, these terms, safety rules, fees, partner controls, or privacy practices. If a change materially affects active use, we may ask you to accept updated terms before continuing.

9. Suspension and termination

• We may suspend, restrict, revoke, or delete access for safety issues, misuse, legal risk, fraud, unpaid fees, inactive or unauthorised partner access, or violations of these terms.
• You may stop using the service and request account deletion. Some records may be retained where needed for security, legal, payment, audit, dispute, or safety reasons.

10. Disclaimers and liability

• I'm Here is provided as a venue-based social tool and does not guarantee matches, meetings, identity verification, venue availability, personal safety, or uninterrupted access.
• To the fullest extent allowed by law, we are not responsible for user conduct, venue conduct, in-person interactions, third-party services, or losses that we could not reasonably control.
• Nothing in these terms limits rights that cannot legally be limited.

11. Contact and disputes

Contact us first so we can investigate account, safety, payment, privacy, or partner access issues. If a separate signed venue agreement exists, that agreement controls any conflicting partner commercial terms.
